J. Michael Thomas Returns to Solo Practice

J. Michael Thomas announces that he has returned to solo practice effective July 1, 2019, following the dissolution of Sparrow Dennis & Medlin PA.

Mr. Thomas will continue to represent clients in commercial litigation, with an emphasis on construction law, and in local land use and code enforcement issues, save and except for the Towns of Oak Ridge and Pleasant Garden, for whom he serves as town attorney.

Committee Descriptions

Awards & Recognitions-Researches and makes recommendations to the Executive Board for annual awards, award recipients, and member recognitions.

Community Involvement-Recommends community service projects to the Association to adopt and runs such projects.

CLE-Plans and presents the Association’s CLE programs for the coming year; expands and enhances the number of CLE offerings of GBA.

Elementary School Project-Arranges a program or project for benefit of students to enhance interest in learning; coordinates the holiday Elementary Book drive for each student to receive the gift of a book.

Herb Falk Society-Serves as a conduit for attorneys to quantify their pro bono services and be recognized for such efforts by carrying the designation as a Herb Falk Fellow. The terms and conditions that will govern this initiative will be recommended by this committee and accepted by the Association before it is instituted.

Health & Wellness-Recommends a health & wellness project for the GBA to adopt and implements such project.

High Point Bar Liaison-Plans events and collaborative projects with the High Point Bar.

History & Archives-Conducts interviews with senior members of the Association; preserves GBA history and records.

Holiday Party-Decides on location, prepares invitations, plans menus, prizes and entertainment for the annual holiday party.

Legal Aid Fundraiser-Identifies a fundraiser project to benefit Legal Aid of NC, and organizes the event.

Membership-Recruits, retains, and engages members through information, involvement in GBA committees and events, and membership meetings.

Memorials-Monitors newspaper obituaries and contacts members regarding deceased members; arranges for notice to members for special seating if funeral (if applicable); arranges to present memorial to the family at a membership meeting; maintains archives.

Newsletter-Publishes 9 issues per year, sends notices to officers and committee chairs, solicits/ writes articles, advises and assists with publication of directory.

Nominating-Presents a slate of candidates for new officers and 3 new directors for the upcoming year, to be presented to the Executive Committee in March, published in the newsletter, and voted on at the April Business Meeting of the Association.

Public Relations-Serves as a liaison between the news media and the GBA, promotes the publication of good news about GBA and its members in the news media, and updates the GBA website and blog.

The Second Chance Project-The GBA’s Signature Pro Bono project, which assists Legal Aid referred clients in obtaining expunctions of criminal records

Reid Phillips Receives Chief Justice I. Beverly Lake Jr. Public Service Award

Brooks Pierce managing partner Reid Phillips was honored by the North Carolina Bar Association (NCBA) with its 2019 Chief Justice I. Beverly Lake Jr. Public Service Award (Lake Service Award). The award was presented at the NCBA’s annual meeting in Asheville, North Carolina.

The Lake Service Award recognizes an outstanding lawyer who has performed exemplary public service and who has made significant contributions to the legal profession. Phillips was nominated by the Past Presidents’ Council and unanimously selected by the NCBA Board of Governors.

A trial lawyer for more than 40 years, Phillips represents large companies in complex business disputes. He was named managing partner of Brooks Pierce in 2016. Phillips has given generously of his time to the advancement of the legal profession. Over his career, he has served as a member of the North Carolina Board of Law Examiners and chair of the NCBA’s Strategic Planning and Emerging Trends Committee. He has chaired the NCBA’s Young Lawyers Division and served on the association’s board of governors and executive committee. He was recently elected as a vice president of the NCBA.

Phillips has served as chair of the Community Foundation of Greater Greensboro, chair of the Greensboro YMCA board of directors, and chair of the War Memorial Commission, which oversees the Greensboro Coliseum complex. He also has been chair of the board of directors for the Green Hill Center for North Carolina Art, and a member of the board of the Weatherspoon Art Museum Association. He counts among his most satisfying projects his involvement in the creation of the Greensboro Aquatics Center, planning and construction of the LeBauer Park, and the expansion of the Haw River State Park.

Among his previous awards and recognitions, Phillips has received Leadership Greensboro’s Denise E. Maleska Leadership Service Award and the Greensboro Bar Association’s Distinguished Service Award. In 2017, North Carolina Lawyers Weekly named Phillips one of its “Leaders in the Law.” He has also been recognized by The Best Lawyers in America, North Carolina Super Lawyers, Business North Carolina’s “Legal Elite,” Chambers USA and Benchmark Litigation, and he is a member of the American College of Trial Lawyers.

Stell: Wellness Comes in All Sizes

Wherever lawyers and legal professionals are gathered, you will find stressful and challenging places to work. Fortunately, there is more awareness of wellness programs and solutions than ever before. Wellness can show up in a new product, tool, app, or practice.

Here are a few of my wellness solutions that are helping me manage stress.

I am loving my Teknion height adjustable desk. As I write this column, I am actually standing. It’s a great way to move around more during the day from the standard “sit in front of my computer” pose. I find that standing at my desk works my core and keeps me more mindful of my posture. If your budget doesn’t allow for a height adjustable desk, make your own. Stack some items on your desk and raise your keyboard or buy a less expensive height adjustable converter.

My Fitbit died in 2018, and I finally bought a new one a few weeks ago. I bought the Fitbit Charge 3 and I love it. This advanced fitness tracker does so much more than track my steps, it monitors heart rate, all day calorie burn, all day activity tracking, reminders to move, sleep tracking, touchscreen, and smartphone notifications. I find I move more during the day with the reminders set to get me out of my seat (or my standing position) every hour.

While I don’t feel I’ve mastered meditation, I am practicing much more frequently. I enjoy the Headspace App and I can set a reminder to mediate for a few minutes at an appointed time during the day. While I do this infrequently, it is a nice calm in the middle of a busy afternoon. With a little trial and error, I have found my best time to mediate is before bed. I use the Insight Timer App. Insight Timer has more free meditations than most other Apps I have tried. There are guided meditations, music, timed mediations, and courses. While there is a free trial on the home page of the App, simply scrolling down and tapping opens 24,000 free mediations that are designed for specific purposes such as dealing with anxiety, boosting your self-esteem, or improving your sleep.

It seems that everyone is Marie Kondo-ing their clutter, and I’m not immune to the challenge. In May, Lawyers Mutual moved offices, all the way across the parking lot from Weston II to Weston I. I love our new space. It is light filled and modern. The best part of the move was also the hardest part, the office purge. We had multiple purge parties this year as we continue to move towards being a paperless office. I don’t think Warren Savage will mind me sharing, but Warren and I love our paper. And our offices were full of it. On bookshelves, the desk, the table, the floor. We had paper everywhere. And I can’t speak for Warren, but I was not that person who could say, “I know where everything is.”

I actually knew where nothing was. I could never find anything. That fabulous manuscript I wanted to go back to and reference? No clue where to find it. That great article that I printed and hole punched and considered putting in a notebook? Nope, can’t find that either. The hotel registration I printed out just in case? Beats me.

The purge was painful. At one point, I had to stop looking at the paper (because I wanted it all) and just start tossing it in the blue recycle bins. And on my many trips to the bins, I most often found Warren standing there with his papers in hand, also trying to decide whether to let go. On one of my trips, Warren was standing there with his BARBRI study guides. Yes, you read that correctly, his BARBRI STUDY GUIDES. From 1996. The good news is that both Warren and I Kondo-d our space. He released the study guides, as I released tons of paper and clutter into the recycle bins, the trash cans, and the donate boxes.

I’m benefiting from less paper and it is directly related to my wellness. As I was forced to get my electronic files in good order and pare the paper down to the necessities, the resulting calm not only made my office look better, it made me feel better. My workspace is more of an oasis than a Bermuda Triangle and I feel calmer and more in control.

I’m a fan of time management tips, articles, and books. My writing coach, Daphne Gray-Grant, recently wrote about a process for establishing a shutdown ritual, her way of transitioning out of the workday. As she describes it, her shutdown routine focuses on tasks that require low energy, don’t need a lot of brainpower, help with organization, and allow her to feel ready to take a break from her work at the end of a busy day. Her ritual is written on a clipboard beside her keyboard and includes eight steps. It generally takes her 30 minutes at the end of her day. Her steps include things such as responding to her coaching class members, responding to social media, tracking product sales, and reviewing bank accounts.

My newly established shutdown ritual involves 4 steps: update my calendar, eliminate Post-It notes by doing the task or moving it to my calendar, update my “to-do” list and schedule my “3 most important things” for the following day. I plan my shutdown ritual for the last 30 minutes of my day. It allows me to leave the office feeling in control of my desk and knowing that when I walk in the next morning, I won’t start the day overwhelmed.

It should not be surprising, but these wellness solutions feel great. I hope you will take some time to determine what wellness solutions you can apply to your professional and personal life.

As we wrap up the year, we want to thank those of you who have been faithful in attending the YLS events.  We encourage those of you who have been missing to make a return next year and we hope you will bring new attorneys to help them find their roots in the legal community in Greensboro.  The year has been eventful for all of us and I have high hopes for next year.  We will soon be welcoming in a whole new group of attorneys.

Trivia night with the HPBA

The Second Annual Bar Association Trivia Battle occurred on Tuesday, April 9, 2018 at WiFi Wine Bar & Shoppe.  Thanks to everyone who came out.  Greensboro brought home the trophy and it was a team of young lawyers who made it happen! Great job, ladies and gentlemen!

NCBA Young Lawyers Division hosted Brews for the Greater Good on April 17, 2019 at Bearded Goat.  It was one of the most successful Brews for the Greater Good events so far!

Swearing-In Ceremony

YLS is pleased to announce that we will be holding a second Swearing-In Ceremony this year for the new attorneys who passed the February Bar! The event will be May 23, 2019, and we will cap it off with the end of the year celebration. The application packets will be available on the YLS Facebook and website when the final details are completed.  We hope to see you there! Please inform any young attorneys you know of the event.

End of Year Celebration

Profile of an Internal Fraudster

Today we hear about fraud from every direction. We stay on high alert for scams concerning our work email or fraud on our personal debit or credit cards. For the second time in six months, my bank has sent me a text message alerting me to fraud on my debit card. When I check my online bank statement, I see that my bank has detected the fraudulent activity and they have already reversed the charges by the time I connect with them. The biggest inconvenience is waiting to receive a new debit card after the fact, but this is a small price to pay knowing that my bank is being vigilant about fraud on my behalf.

The Association of Certified Fraud Examiners, the world’s largest anti-fraud organization, released their 2018 Report to the Nations. Here are some of their conclusions after examining 2,690 cases of occupational fraud in 125 countries involving 23 industry categories from January 2016 – October 2017:

  • Median period of time fraud occurred before being caught – 16 months
  • Median amount of loss – $130,000
  • 22% of cases involved losses of $1 million+
  • Tips are by far the most common initial detection method at 40%, compared to 15% by internal audit and 13% by management review. Employees provide over half of the tips.
  • Small businesses lost almost twice as much per scheme to fraud – $200,000 in median loss for businesses with fewer than 100 employees, compared to $104,000 median loss in businesses with 100+ employees
  • Fraudsters who had been with their company longer stole twice as much – employees with more than 5 years tenure took a median of $200,000, compared to employees with less than 5 years tenure took $100,000 median
  • Internal control weaknesses were responsible for nearly half of frauds
  • Companies with anti-fraud controls were associated with lower fraud losses and quicker detection
  • Only 4% of perpetrators had a prior fraud conviction
  • Over the past 10 years, occupational fraud referrals to prosecution declined 16%. The top reason for non-referral was fear of bad publicity.
  • A majority of victims recovered nothing

Unfortunately, law offices are not immune to employee theft. Consider these red flags that could apply to lawyers or staff who are taking money from the firm:

Personal

  • Undergoing known financial difficulties
  • Divorce or other major life changing events
  • Unexpected change in behavior
  • Instability in their life circumstances
  • Past employment related problems
  • Past legal problems
  • Living beyond their means or an excessive lifestyle
  • Desire for personal financial gain
  • Excessive family or peer pressure for success

Professional

  • Unusually close relationship with vendors or clients
  • Serves as primary contact with law firm bank and payroll vendor
  • Often makes tasks more difficult than necessary perhaps to obfuscate or reduce transparency
  • Overly protective about their workspace
  • Prefers to work unsupervised, after regular work hours or frequently takes work home
  • Complains about lack of authority or a micro-managing work environment
  • Complains about inadequate pay
  • Complains about excessive work pressure and stress
  • Reluctance to take vacations or extended time away from the office
  • Reluctance to delegate or allow assistance from others

Personality Traits

  • Control issues manifested in such ways as an unwillingness to share duties or asking fellow employees not to go through their mail or work product while they are out of the office
  • Excessive secrecy or trust issues
  • Irritability, suspiciousness or defensiveness
  • Confrontational when challenged
  • Tells lies, even about unimportant items
  • Unreliable
  • Cuts corners or bends the rules
  • Tends to shift blame and offer excuses

Law firms often fail to see the red flags. Lawyers sometimes delegate tasks that are associated with finances, billing, receivables, ordering supplies and maintaining bank and payroll company relationships. As a result, there are missed opportunities to detect or prevent fraud. Also, as employers fail to respond to red flags, the fraudster often feels more emboldened to continue the fraud and often in increasing measures. First, the target is the petty cash fund, then payroll or the trust account.

Steps to Prevent Employee Fraud

  • Create a positive work environment that encourages employees to follow established policies and procedures
  • Implement internal controls and proper checks and balances
  • Screen potential employees carefully – use pre-employment background checks, use a respected recruiting firm, check references
  • Educate your employees on trust account guidelines
  • Reconcile firm accounts regularly
  • Have the firm’s financial statements sent directly to managing attorney
  • Perform random audits
  • Rotate job duties
  • Require dual signatures on checks
  • Do not allow signature stamps to be used
  • Implement mandatory vacation policy
  • Offer to assist employees who are experiencing stress or difficult times (programs may be offered through your insurance program such as Employee Assistance Programs or wellness programs)
  • Obtain employee dishonesty insurance coverage (Adam Pierce at Lawyers Insurance Agency can assist)
  • Trust your instincts

Recognizing red flags and being willing to act on them could save your law firm money and even more importantly, your law license.

Message from the President, May 2019

Greetings!

It is hard to believe that our meeting year is almost over. As they say, “all good things must come to an end.”

I would like for you all to know that it has been a pleasure to serve as your president this meeting year. After the loss of my husband in May of 2018, it was unclear whether my loss would hamper my ability to lead this great organization. As it turns out, the opportunity to serve as your president was just as my late husband and I thought it would be. You see, we discussed whether I should accept the nomination of president once the opportunity was presented. At that time, we knew his prognosis was quite grim. However, given my personality type, we agreed that having this challenge could be cathartic if he transitioned from this earthly life to his heavenly life. As expected, I found my experience to be fulfilling and therapeutic. I truly believe that our talents and abilities are meant to be utilized in serving others.

It has been an honor and privilege to create opportunities with the goal of offering great value for your membership.

I would be remiss if I did not thank Diane Lowe and an amazing board of Directors, as well as committee chairs and committee members, for their leadership and contributions throughout this meeting year. We made great strides by providing two free Continuing Legal Education sessions in the fall and spring, as well as our Annual C.L.E. Seminar. We raised well over $20,000.00 for Legal Aid of North Carolina, donated books for the students attending Jones Elementary, served as volunteers for the Potter’s House, recognized several members for their accomplishments in the legal profession and/or community, provided opportunities to walk in the Human Race and/or donate blood to the Red Cross, and were triumphant over the High Point Bar Association in the Battle of the Bars Trivia competition. The year was not without challenges. However, we resolved one of our major challenges regarding where to host our lunch meetings by securing the Greensboro Country Club, which is conveniently located to downtown.

In closing, I would like to thank each of you for allowing me the opportunity serve as your president for the 2018-2019 meeting year. It has been an honor and privilege to create opportunities with the goal of offering great value for your membership. I wish our incoming president, Eric Richardson, and his leadership team great success in the upcoming year. I hope you will join us for the final gathering planned for this meeting year. We invite each of you to celebrate the end of our year with food and fellowship at a Greensboro Grasshoppers game scheduled in May 2019.

The Human Race was a great success. Twenty two GBA members walked in the April 27th 5K event organized by the Volunteer Center of Greensboro. Many others donated which spurred us to raise over $2,100 for non-profits in Greensboro.

There had been rumblings about who would win the Second Annual Bar Association Trivia Battle. At the High Point Bar Association Meeting, they mentioned at every meeting how they would keep the trophy at home. Greensboro Bar Association members discussed preparations months in advance.

The winning team answered an entire category correctly. Our own Sharon Dunmore was able to assist her team in correctly distinguishing spells and charms from Harry Potter from obscure terms that have appeared in legal opinions over the years. Mutatis mutandis, anyone?

Members of the GBA and HPBA worked together to plan a location, to create a budget, and to bring everything together, including a host. Trivia topics included Expecto Patronus or Ex Post Facto; general knowledge; famous law school graduates; and Child’s Play.

From the platform where the host announced the questions, it was apparent that spirited discussions and debates were taking place. Laughter could be heard over drink orders and, often, over the trivia hostess. Even the staff at WiFi Wine Bar joined in. Jokes were made at the expense of those who didn’t attend – all in good fun, of course.

The trophy now resides in Greensboro, thanks to a group of young lawyers. More importantly, however, it was obvious that this event bridged gaps between groups – attorneys and judges, old and young, litigators and transactional attorneys, and GBA and HPBA.

Fred Lind Receives Caswell Award

Congratulations to Guilford County Public Defender Fred Lind, who was honored with the prestigious Caswell Award in recognition and appreciation for 45 or more years of dedicated, extended service to the State of North Carolina.

The ceremony was held Tuesday, April 2, at the North Carolina Museum of History in Raleigh and honored 21 employees across state agencies and branches. Lind became the assistant public defender in September 1974 and then Guilford County’s chief public defender in 2011.

Phillips to Receive NCBA Public Service Award

Reid L. Phillips has been selected to receive the 2019 Chief Justice I. Beverly Lake, Jr. Public Service Award at the NCBA Annual Meeting in Asheville.

His name was placed in nomination by the Past Presidents’ Council and approved unanimously by the NCBA Board of Governors at its spring meeting in Wrightsville Beach.

A graduate of the University of North Carolina at Chapel Hill (1974) and the University of Texas School of Law (1977), Phillips has practiced his entire career with Brooks Pierce, serving as managing partner since 2016.

He has provided leadership to the Community Foundation of Greater Greensboro and the LeBauer Park Steering Committee, and in 2015 served as chairman of the War Memorial Commission which oversees the Greensboro Coliseum Complex.

Stell: The Value of Your Insurance Policy

Have you ever struggled as you tried to help a client understand why they should hire you? Why they should be willing to pay their hard-earned dollars to you? Why their problem is one that is in need of a legal solution?

That’s a struggle faced by all firms or businesses that provide a service. We often don’t have a tangible product. Or if there is a tangible product – such as a will that can actually be printed on paper, the value is much more than the price of the paper.

At Lawyers Mutual we often say, we aren’t selling you an insurance policy – though you certainly have one that can be printed on paper – we are selling peace of mind.

Our peace of mind comes in the form of the many services that we provide. One service is providing CLE speakers for local bar meetings. We have had the good fortune to spend time with the Greensboro Bar at CLE events as well as social events. We always appreciate you inviting us over and we hope you will continue to do so. The features of our HELP team include: Assessment, Action Plan Development, and Client Protection. These services are offered at no cost, and often with no trigger of deductible, although every situation is unique. Our claims counsel can guide you through the process.

Another resource is our Claims Prevention program which includes our education and CLE programs, our risk alerts, and monthly e-newsletters, as well as the many Risk Management resources available on our website including checklists, forms, sample letters and toolkits.

We encourage you to think of our claims attorneys as your partner down the hall. Call our toll-free number at 800.662.8843 and talk with our claims attorneys about how to handle difficult clients, if and when you should fire a client, or how to handle a potential legal problem. Our claims counsel can also guide you through ethics or professionalism dilemmas. We also provide subpoena assistance. If you receive a subpoena, make sure your first call is to one of our claims attorneys to provide guidance and action steps for responding.

One of our most popular resources is our Claims Repair program which begins when a claim is reported.  We determine if the error can be corrected or the damage lessened to avoid a claim by a client. This program is led by an experienced team of in-house claims attorneys and outside counsel. Each day, these seasoned professionals work side-by-side with our insured attorneys on clams repairs large and small. Sometimes, claims can be fully repaired while other times the dollar amount of the loss is significantly reduced. The success of Claims Repair efforts is dependent on a timely claim report.  It is vital that a potential claim be reported to us as soon as the issue is discovered. Of particular note, our claims attorneys spend a great deal of time advising insureds on matters before they become a claim or before an insured would take action that could result in a future claim.

Lawyers Mutual Consulting & Services is a subsidiary of Lawyers Mutual. We will offer business development and marketing coaching to lawyers through a subscription, online platform that we hope to roll out in early 2019. We are also focused on helping lawyers develop succession plans. Succession planning does not mean retirement today, but rather building a plan that allows you to control your future and plan for the health and legacy of your law firm after your retirement. I am Larry L. Archie and I have been practicing criminal law in Guilford County for 12 years. I am a graduate of Cleveland-Marshall College of Law and North Carolina Agriculture and Technical State University. In addition to practicing law, I serve as an U.S. Army Reservist at the current rank of Lieutenant Colonel.  I sincerely look forward to working with all of the attorneys of the 18th Judicial District.
